The Value of an Estate Plan

Will – Lets you decide who inherits your assets and who you appoint to be your personal representative (the person who will be in charge of your estate).
Trust – Lets you decide whether or not you wish to use an estate planning trust and a discussion about advantages of the use of a trust.
Power of Attorney – Lets you appoint your spouse or someone you trust to act in your behalf in the event you become disabled. Without a Power of Attorney, if you become disabled, a guardian or conservator needs to be appointed in a court proceedings to manage your assets. The question: Who do you want to manage your assets if you become disabled, your family or a Minnesota district court?
Deeds – Lets you gift your land to who you want to own it after you have passed away, i.e. Transfer on Death Deed.
Health Care Declaration (most commonly referred to as a “Living Will”) – Lets you put in writing your plan for end of life health care and which family members will be part of that process.
